RE: The tariff classification of a glass lamp shade from Spain.

Dear Ms. Denny:

In your letter dated February 1, 1996, on behalf of Lightolier, you requested a tariff classification ruling. The sample, which was received in a broken state, is being returned as requested. The sample submitted is a half-moon shape glass lamp shade, model Vetri Murano, which is designed to enclose the bulb of a wall-mounted lamp in order to decrease the glare of the light.

You state that the subject merchandise, referred to as a "diffuser," should be properly classified under subheading 9405.91.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for other glass lamp parts. Although this article is so constructed to diffuse the emission of the light, it is primarily designed to function as a shade which prevents the light source from being directly visible at normal angles of view.

The applicable subheading for the glass lamp shade, model Vetri Murano, will be 9405.91.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for other glass lamp shades. The rate of duty will be 13.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
